You simply search all relevant patents, patent applications, trade journals and other similar inventions, throughout the world, thus getting a sense of the state of the art. You then identify which parts of your idea form the basis for a "new and non-obvious" invention, document the invention as a patent application, and file it. You do not need a prototype or to "prove it works". The examiners in the patent office (under US law) have the burden of proving your invention doesn't qualify for a patent. They generally try to initially reject one or more of your claims, based upon their being "anticipated" or "obvious" from prior art. Your patent attorney has various ways to deal with such things, so you can get at least SOME part of the invention patented. Plan to spend about $10,000 on a simple invention and up to 10 times that much for a complicated one. Also, consider filing an application for a patent in more than one country, depending upon where you believe your competition might be centered.

even with a patent and a prototype, it's then up to you to try to convince a company it will sell and be profitable - most patented inventions go nowhere
YOu do not have to spend zillions of dollars. You can get STARTED for $65 with a Provisional Application for Patent, go to Shark Takn and say you have a Pending Patent, do an AQWESOME presentation and your total cost is $65 Plus airfaire, the cost of your fancy clothes you choose to wear, and a stay in a hotel. Not such a bad deal! eh?

There are LOTS of ways to move forward with your invention. I would caution you away from paying ANYONE ANYTHING until you COMPLETELY understand what and when they will give you what you want.
DO NOT pay anyone $5,000 to start your invention... Not even invention companies until you COMPLETELY understand exactly what they will do for you. I have talked to way too many folks who have spent from $1800 to $5000 to get nothing.
Not to worry.. there are ways to get what you want ant YOU can do it yourself, for the most part, and it is fairly easy to do everything. Just know the USPTO if a branch of the Federal Government and the Federal government wants YOU to be a millionaire so you can pay taxes. Therefore, the Federal Government, via the USPTO, makes it EASY to file a Provisional Application for Patent. Extremely easy.
