Off the top of my head, I would say "fake". The photograph is dark, but it looks like a stainless steel model. No stainless steel model has stones set in the bezel. The sub dials look to be in the incorrect position with respect to the writing. That is typical of a fake Rolex Daytona.
Usually the Daytona has a red second hand if the dial is white. The watch is for timing horse or car races, so the second hand is supposed to be very easy to see.

If the long "sweeping" second hand is moving all the time, it is fake. If the bottom (6:00) sub-dial is not moving it is fake.
On a real Rolex Daytona, the long second hand normally sits at 12:00 except when the "stop watch" or "Chronograph" function is being used. The long second hand, and the sub-dails (3:00 and 9:00) are used for the "chronograph" function. The bottom (6:00) sub dial counts seconds all the time.
On a fake Rolex the sub dials are usually a date function. If you press the buttons on either side of the "crown" (winding knob) the date changes.
If it says "Winner 24..... Blah blah" on the back it came from Hong Kong and costs about $10 wholesale although many "Ang moh" will pay up to $300 for them.
You can always take it into the dark. If the hands and markers glow in green it is fake.
You can put it in your jeans pocket, and put it though the wash cycle. If it comes out full of water or in pieces it was a fake. If it is still keeping time then it is real. In other words fake Rolex are not terribly water resistant.
Lastly shake it. If you hear a metal against metal scraping sound, then it is fake.
Fake Rolex are made with hex covalent chromium, (same stuff used to make chrome car wheels) and are very toxic to the skin.
Well Its difficult to say much from the photo but here are some clues:
1) A fake Daytona will Usually have a dummy / Faux Chronograph where the big second hand is always running and there is no way to stop it.
2)Fakes usually have "Winner Rolex 24" on the case back.
3) If its stamped 18k on stainless steel or coated PVC.
4) No serial numbers between the lugs.
5) Pushing the top Chrono Pusher moves the small dial @ 9 / Pushing the bottom Chrono Pusher moves the small dial @ 3
6) Plastic Holding the Chinese Movement
