I think you should have used the word "Empty" Xbox box and been clear it did not include the Xbox device. I don't think you should ship it. I think you should contact them and make sure they are aware it is just the empty box. And hopefully they will agree to quietly mutually cancel the sale via the Ebay mechanism for doing that, and you return the money.
It sounds to me like you were aiming to confuse if either of these is true:
- you set that high ($400) a Buy It Now for an empty box
- multiple people were confused and bid it up that high
I think you could face legal charges for scamming = fraud.
Others have try to pull lame tricks like that. Unless it has clearly stated it was just the box and not the console, eBay will give the money back to the buyer and may suspend your account. Ebay don't want to become Craigslist and trying to get rid scams like you.

if the buyer gets the media involved then you are screwed; ebay cannot look like a place where stupid people loose their money.
but if he just opens a case then you might have a chance; after all the day one boxes are collectibles, in 20 years they might actually be worth $400.
Yes, you should be concerned. An empty box is a prohibited item as far as eBay is concerned.

When your buyer complains, they will be refunded and you will be suspended (or kicked off of eBay permanently). And that refund comes directly from you.
Your best (and only solution) is to refund the buyer and apologize.
You should post with capital letters "BOX ONLY NOT THE ACTUAL CONSOLE" Of course he will be pissed and come after you.

No, if you print out the page showing that you stated it being the box, you can prove the judge that it was a box you sold. hopefully, idk :)
I literally sold an xbox day one edition BOX. Without the actual console... For $400. I included it in the title saying that it was the BOX. But I still have a feeling my buyer thinks it's the console. If he gets the item and gets upset, do I have to return it? Will I get sued?
