However there's your problem - How would you prove that?

And how would getting an expert make any difference to that.?
Personally I dont think you have much chance of proving it was broken when you bought it, so I wouldnt bother and would buy a new one.
You can open a dispute in ebay for "Item not as described". ebay will then ask the seller to comment.
If the seller maintains that it was in excellent working condition then it would be up to you to prove the item was faulty, probably by an engineers report. In general in these disputes ebay tend to take the buyers side and if they decide in your favour they will order the seller to refund you upon return of the goods. You would have more protection if you had paid by paypal !
Get the seller on the phone.
Even though you didn't go through PayPal the seller still doesn't want negative feedback and low DSR scores. He will in all likely hood work this out with you.

Sadly this is one to write off to experience because you paid in cash.
We bought a used dishwasher on ebay which was advertised as being in 'Excellent working condition', we collected in person (we drove 25 miles to collect) and paid cash on collection.
the gent we bought the item from had taken the dishwasher out of his kitchen and it was at the door waiting for us, he did offer to plug it in to demonstrate it turned on but we didn't think it was necessary.
We've installed the dishwasher and it turns on and fills with water but does not do anything else.
I've messaged the seller but he hasn't got back to me yet.
Are we entitled to a refund or will we have to write this off as a bad ebay experience and buy a new dishwasher?
