A new seller has a 21 day pending hold. That means they have not received the money, paypal does. You need to go to resolution center and click on item not received. The ball is in their court. They can send the item they do not have, offer a refund or let ebay take care of it. As 1 other poster stated, please use only ebay messenging service. At this point open the claim NOW and have no further contact with the seller.
You have tried contacting the seller. You now go to the Resolution Center and file an Item Not Received dispute so Paypal can refund you
You bought an item that the seller did not have for sale? Open a dispute in the Ebay Resolution Center. You can get a refund.
First, don't communicate with them by email, only use ebay messaging otherwise there is no audit trail for ebay to look at. Open an "item not received" case (when it lets you) and you will get your money back, even if they have already withdrawn it, they would get a negative balance if they have spent it and paypal would pursue them for the money. You will always win when this happens but do not communicate outside ebay again, if they will not talk on ebay just ignore emails. It may take a week or two but you will get the money back through paypal, I guarantee it. Also, add the account of this person to your "blocked buyers list", you don't want them ever buying from you neither.. If there is a payment hold, he should still send the item before the hold is lifted or he is breaking the rules.
Contact the seller to refund your payment. If they refuse, contact Ebay resolution service. Tell them what happened.
Contact PayPal and see if they can retract the payment if it has not been made yet. Also contact eBay and report the seller.
