I recently got a phone plan with metro pcs for $40 a month with tax and fees included in the 40 dollar but my monthly bill came to $46.67 can i sue them for false advertisement?

Put your lawyer back in your holster. It is true that the plan includes taxes and fees, but are you certain you did not also select one of their add-ons which do cost more and have taxes assessed on them?

Contact customer service and ask them what the extra is for, if you are unable to read your billing detail and figure it out.

If you do sue, plan on your lawyer taking about $2.67 for his professional fee, and then deducting his costs for postage, phone calls, and expert witnesses from the $4.00 left to you. So you may end up with $1 or so.

And, if you do not cancel your account with Metro PCS immediately, you weaken your position in court ("What? You felt you were ripped off and yet continued to use their products and services?").

You clearly didn't read the sales agreement. The agreement says $40/month plus communication taxes.
